U.S. Warning Label Requirements on Electronic Cigarette Packaging

1.Warning labels on e-cigarette packaging

U.S. regulators require tobacco product packaging to have the following statement: “WARNING: This product contains nicotine. Nicotine is anaddictive chemical.

This warning must appear on the packaging of tobacco products. In the United States, it is illegal for any individual to manufacture, package, sell, offer to sell, distribute, or import tobacco products without warning labels.

Warning labels and California Prop 65 warning

Animal children warnings need to be marked: Keep this product out of reach of children and pets.

Warning labels must appear directly on the packaging and be clearly visible under the cellophane or as follows:

  • a.Warning labels are clearly visible in 2 main display areas on the packaging;
  • b.The area of ​​warning labels should occupy 30% or more of the display area of ​​a single package;
  • c.Print in at least 12-point font and occupy as much as possible the area of ​​the warning label with the text reserved;
  • d.Typography must be legible in Helvetica bold and Arial bold, and the typesetting, layout, and color may be bold on a white background or white on a black background;
  • e.Capitalization and punctuation as required by 1143.3(a)(1);
  • f.The printed font is required to be in the center of the warning area, and the required warning words need to be in the same direction as the main display area.

Export requirements: The nicotine content in the United States is not required, and the nicotine content exported to the European Union does not exceed 20mg/ml. The product packaging must have a child-resistant label, and be tamper-proof and leak-proof, and marked with a health warning. The packaging is prohibited for advertising and promotion purposes.

U.S. packaging is required to display the California Prop 65 warning:
“WARNING: This product can expose you to nicotine, a chemical known to the state of California to cause cancer. For more info, go to: www.P65warnings.ca.gov”

2. Marking requirements

According to the different packaging requirements of various countries and regions, the corresponding certification mark, safety mark and other relevant identification information should be reflected on the outer packaging page.

Take the age label as an example, the United States requires 21+, and the EU requires 18+.

The CE mark is the EU compulsory certification mark, which is the license for products to enter the EU market, and is also the EU’s supervision method for products entering the EU market. Products affixed with the CE mark indicate that the product meets the EU’s relevant safety, health, environmental protection and other regulatory requirements.

RoHS is a mandatory standard formulated by EU legislation, its full name is “Restriction of Hazardous Substances”.

The standard has been officially implemented since July 1, 2006, mainly used to regulate the material and process standards of electrical and electronic products, making it more conducive to human health and environmental protection.
